Does arguments between families create further problems?

Post by Major Thom » Sun Jan 20, 2019 6:52 pm

Just heard tonight that 2 people we know have been handed the Capitol Punishment verdict. There were two families that had been arguing for a while about the ownership of a certain thing. The argument spilled out basically into near warfare and a person was fatally injured. I wonder when this went to court if the past arguments and warfare had been taken into consideration, if so I believe the sentencing should have been manslaughter. We were sorry to hear that two brother had been handed the death sentence for an argument that got out of control. We knew these brothers and we sincerely pass our condolences to the family.

I'm of the opinion that apart from a genuine accident causing the death of a fellow human being, then all others causing the death of someone, no matter the circumstances, lose their right to live if and when found guilty, allowed an appeal, looses, then they should swing. Commiserations to the swingers family and friends are an insult the the aggrieved family and friends, a murder is a murder.

But Murder with mitigating circumstances is Manslaughter....Wonder if the mitigating circumstances were heard? All together in the space of 1 week 7 people were sentenced to the rope from the West Bank.

I'll be honest... I'm not sure that I actually fully understand the question raised.

My instinctive response is to say that arguments between families can, create further problems.

As far as

I would have to question whether that is legally true in Egypt (or some other countries too).

I would also suggest that 'mitigating' can be applied both subjectively and objectively, so it is not necessarily a reliable measurement in deciding if the punishment fits the crime.

MT is right in that, in the UK, provocation is a defence against the charge of murder, reducing it to manslaughter in appropriate cases.

In Egypt? Who knows. There you can be sentenced to death for " offences" which simply wouldn't be offences in UK.

It does seem that way Newc. But I am sure like Hepzi says there are many other Countries that do not apply provocative circumstances either, it's either Black or White.
